Competition

By participating in the competition, the participant accepts the following conditions of participation as binding:

§ 1 Organizer of the competition
The organizer of the competition is P3 Security GmbH, Frühlingstraße 22, 85221 Dachau.

§ 2 Prize
The prize is 1 x 1 iPad (6th Generation) Wi-Fi with 128 GB in gold.

§ 3 Participation and duration

  • Only persons of legal age are eligible to enter the competition, i.e. persons who have already reached the age of 18 at the time of entering the competition.
  • Only persons who are resident in Germany during the participation period are eligible to participate.
  • Competition period: 14.12.2018 from 07 am to 24.12.2018 at 09 am. Only those who participate within the deadline set for this purpose will be admitted to the competition.
  • Each participant can only take part in the competition once.

§ 4 Exclusion from participation

  • Employees of P3 Security GmbH and their relatives are excluded from participating in the competition.
  • In the event of a breach of these conditions of participation, P3 Security GmbH may exclude the participant from taking part in the competition.
  • Persons who make use of unauthorized aids (competition robots) or otherwise gain or seek to gain an advantage through manipulation are also excluded. In such cases, P3 Security GmbH reserves the right to subsequently withdraw and reclaim the prize.
  • Participants who do not provide complete or truthful information about themselves may be excluded from participation.

§ 5 Implementation and processing

  • To take part, users must post a video under the competition entry that picks up on the colors black and gold.
  • Videos that infringe the rights of third parties are excluded from the competition.
  • The winner who posted the most creative video will be chosen from all the valid videos posted and notified personally via social media.
  • The winner will be drawn on Monday, 24.12.2018.
  • The winners will be notified by personal message by P3 Security GmbH.
  • The winners will receive their prizes by post to the address provided. The prizes will be sent by P3 Security GmbH.
  • There is no entitlement to substitute cash payment for non-cash or other prizes or to subsequent changes to the prizes. Assignment or resale of the prize is not possible or prohibited.
  • There is no entitlement to the transfer of the prizes or to an exchange of prizes.
    If the winner does not contact P3 Security GmbH within 4 weeks after the prize notification has been sent to the address provided by him/her and declares that he/she accepts the prize, or if he/she cannot be contacted at the data provided by him/her, his/her entitlement to the prize shall lapse. The same applies if the winner fails to provide the necessary cooperation for the transfer of the prize. If the prize is forfeited, there will be no new draw among the remaining participants.

§ 6 Participant-generated content

  • Participant-generated content must comply with applicable law. In particular, content must not contain pornographic, racist, political or religious content or infringe the rights of third parties (such as copyright, trademark or personal rights).
  • The participant expressly affirms that he/she owns all rights to the content in question, has unrestricted exploitation rights to it, that it is free from third-party rights and that no third-party rights are infringed.
  • If there is a suspicion that a participant is using illegal content to participate in violation of Section 6.1, P3 Security GmbH reserves the right to exclude the participant from participation at any time and to delete the content in question.
  • If the competition requires participants to upload video or photo recordings, the person depicted in the photo or video may only be the participant themselves.
  • P3 Security GmbH is entitled to modify and edit the content for the purpose of the competition. In doing so, it shall safeguard the personal rights of the participant.
  • The participant grants P3 Security GmbH the non-exclusive rights of use to the content free of charge, unlimited in terms of territory, time and content. This includes, in particular, the use of the content to carry out the competition and to report on it in the press and other media.
  • In the event of a breach of the rights and guarantees of legality given by the participant, the participant shall indemnify P3 Security GmbH against all claims asserted by third parties against P3 Security GmbH. In addition, the participant undertakes to support P3 Security GmbH in any legal defense in the event of a legal dispute and to bear the costs of the necessary legal defense, including all court and legal fees. Any further claims for damages by P3 Security GmbH against the participant remain unaffected.
  • If the participant violates the aforementioned conditions of participation, the participant shall indemnify and hold harmless P3 Security GmbH and the managing directors, representatives and employees of P3 Security GmbH against any claims or demands of any kind made by third parties based on or in connection with content provided and/or transmitted by the participant in the context of his/her participation in the competition upon first request. This also includes reasonable legal fees and court costs.

§ 7 Reservation of the right to terminate the competition at any time
P3 Security GmbH reserves the right to cancel or terminate the competition at any time without prior notice and without giving reasons. P3 Security GmbH is particularly entitled to do so if the proper execution of the competition cannot be guaranteed for technical or legal reasons.

§ 8 Liability

  • P3 Security GmbH is released from all obligations when the prize is handed over, unless an earlier point in time results from these regulations.
  • P3 Security GmbH assumes liability in accordance with the statutory provisions. In the event that the prize cannot be handed over/accepted for reasons for which the winner is responsible, the claim to the prize shall lapse.
  • P3 Security GmbH shall only be liable for damages in cases of intent and gross negligence. This shall not apply in the event of injury to life, limb or health. This also does not apply to the violation of essential contractual obligations. These are obligations that are essential for the execution of the prize game, as they make it possible in the first place, and on the fulfillment of which the participant therefore relies and may rely. Compensation for the breach of essential contractual obligations is limited to foreseeable damages typical for the prize game, unless there is intent or gross negligence or liability for injury to life, limb or health.

§ 9 Miscellaneous

  • All information is subject to change. Legal recourse is excluded.
  • The place of jurisdiction is Dachau.
